EASTHAM BOARD OF HEALTH MEETING
THURSDAY, SEPTEMBER 30, 2010

OPENING STATEMENTS
Dr. Lois Roth-Johnson spoke about the success of the unwanted medication disposal program which helps educate the public about proper disposal of medication. She stated how important this program is in order to eliminating flushing medications down the toilet or pouring them down the drain.
Beverly Knox helped on September 25, 2010 at the Nationwide Unwanted Medication Disposal collection conducted at the Police Department. Beverly informed the Board that Officer Bohannon was in charge of the collection which was a great success and well received by Eastham residents.
Jane Crowley thanked Beverly for volunteering at the Disposal Day. Jane also informed the Board that there is also a free disposal sharp program. The drop-off location in Eastham is at the Fire Department 8- 4 Mon-Fri.
Jane told the Board the dates for the flu clinics are October28 and November 4 at the Council on Aging- 9:00 am to noon. A date for the Flu shots for the high School should be decided in the next few days.
VARIANCES
1. Charles & Jacqueline Wilson 780 Governor Prence Rd. Map-17 Parcel-685
Mr. Robin Wilcox (Sweetser Engineering) presented the revised septic plan dated August 11, 2010. The variances requested include:
15.211 Sec. I-C4 Distance of Soil Absorption System to Potable Well
100 feet required - A 24 foot variance requested
15.211 Sec. I-C4 Distance of Soil Absorption System to Crawl Space
20 feet required - A5.6 variance requested
15.248 Sec. I-C4 No reserve area provided
Finding that the applicant has submitted plans that meet maximum feasible compliance that could have been installed in full compliance if the NStar easement did not create use constraints.
The Board approved the plan with the following conditions:
1. Voc and routine quality test results be provided of existing well location to assure potability.
2. No increase in design flow.
3. Pressure dosing be added to design plan with pump chamber.
4. Deed restriction for 5 bedroom use and pressure dosing to be recorded
Dr. Lois Roth- Johnson made the motion to approve the plan with the 4 conditions.
Dr. Martin Haspel seconded the motion.
THE VOTE WAS 4 IN FAVOR -1 OPPOSED
2. Marsha Olsen 950 Old Orchard Road Map-8 Parcel-19A
Marsha Olsen and David Lajoie (Felco Engineering) came before the Board to resend the provisional approval for Title 5 system with Advantex AX20 as listed per plan by Felco
7/22/2010. The owner requested approval for a conventional Title 5 septic system with proposed 2 bedroom floor plans. Ms .Olsen informed the Board that this will be her retirement home.
The Board approved the request with the following conditions:
1. Deed restriction for 2 bedrooms.
2. No increase in habitable space.
3. Any change in flow would require notification to abutters and Board of health Review.
Pat Lariviere made the motion to approve the request to resend Advantex AX20 as listed per plan by Felco 7/22/2010.
Dr. Lois Roth-Johnson seconded the motion.

REVIEW
3. Jeffrey Kobold 900 Old Orchard Road Map-8 Parcel-39
David Lajoie (FelcoEngineering) submitted a plan for nitrogen reduction capability utilizing the Waterloo Biofilter On - Site Wastewater System.
Finding that the applicant has submitted plans with secondary treatment and pending successful submission of design details approval was granted with the following conditions:
1. Routine water and VOC quality test results be provided of proposed well location to assure potability.
2. No increase in design flow be allowed
3. Secondary treatment Waterloo Biofilter Model UG 550 and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). Effluent nitrate-nitrogen not to exceed 19mg/1.
4. Operation and maintenance agreement to be submitted to Eastham Board of Health.
Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
5. Deed restriction for 4 bedroom use and use Waterloo alternative technology requirement to be recorded on deed.
6. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
7. Any increase in habitable square footage would require Board of Health review and abutter notification.
8. Complete design details and requirement of technology to be submitted for approval.
Beverly Knox made the motion to approve the plan with the 8 conditions.
Pat Lariviere seconded the motion.

4. Rocky Melchiorri 1140 Kingsbury Beach Road Map-10 Parcel- 332
Mr. Robert Perry (Cape Cod Engineering, Inc.) submitted the plan for Title 5 system with
secondary treatment Advantex AX20 Model 3B dated 9/3/2010.
Finding that the applicant has submitted plans with secondary treatment approval was granted
pending successful submission of design details with the following conditions:
1. Routine water and VOC quality test results be provided of proposed well location to assure potability.
2. No increase in design flow be allowed inexcess of 2 bedrooms
3. Secondary treatment Advantex AX20 Model 3B and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). Effluent nitrate-nitrogen not to exceed 19mg/1.

IV. APPEAL
Ian McConnell 25 Hoyt Road Map-10 Parcel-128
5. Mr. Ian McConnell came before the Board to appeal the violations #1267, #1268,#1269 at his rental property. Mary Beth O’Shea from the Town Clerk’s Office informed the Board that as of August 6, 2010 there were no renewal rental Certificates on file for any of the three properties owned by Mr. McConnell. Failure to register is a violation of the Eastham Board of Health Regulations, Section III subject to a fine of $300.00for each offense. Mary Beth O’Shea stated as of this date $150.00 has been payed for rental certificates.
Dr. Martin Haspel. made the motion that the remaining fine of $750.00 be received by the Town Clerk’s office before any rental certificates are issued.
Dr. Lois Roth-Johnson seconded the motion.

(Notice to abate continued)
Attorney Richard Laraja representing the Blinders requested to allow the renovations in the basement of their property to remain. Violations on the property was reported to the Eastham Health Department by the Eastham Electric and Plumbing Inspectors for work that has been conducted in violation of Board of Health orders issued.

no plumbing to be installed in the basement.
At this time the one bedroom deed restriction has been recorded and received by the Health Department.
Dr. Lois Roth-Johnson made the motion the owners now remove the shower and wall in the basement by January 1, 2011subject to reinspection when work is complete.
